            <title>Atlanta Rainy Day Accidents Cause Serious Injuries and can be Fatal</title>
            <description><![CDATA[<p>From the day I moved here over 20 years ago, I have always felt that the roadways in Atlanta and North Georgia are treacherous during heavy rains, especially at night. I regularly represent clients injured in rainy day accidents, and I just read an article in the AJC online about a  fatality near Lenox Square in Buckhead Friday night.  A Duluth man was killed around 11 o'clock when his vehicle traveled into the path of oncoming traffic striking another vehicle.  The driver of the other vehicle was seriously injured and was taken to the Grady trauma center, and his passenger was also taken to Grady with cuts and bruises.  The Duluth man died of head trauma and was pronounced dead at the scene.</p>]]></description>

As a child victim of a violent attack by a German Shepherd, I have a very keen interest when dogs attack, especially when they attack children.             <title>Child injured at Atlanta Daycare Severely Burned and Scarred by Owner&apos;s Negligence</title>

The child was 4 months old at the time of the incident.  The day care provider wanted to put the child down for a nap.  There were other children playing in the common/family room, so she took the baby into her bedroom and laid the child on the floor to sleep.  Apparently, after leaving the child, for some reason (most likely the child screaming), the day care provider returned to the bedroom to find that the child had scooted up against an unguarded space heater and received deep second degree burns to the most of the length of the outside of her left leg.</p>]]></description>

            <title>Atlanta Tractor Trailer Injury Lawyer Applauds Citations given to Driver After Causing Recent Accident</title>
            <description><![CDATA[<p>As an <a href="http://www.victorfaenza.com/lawyer-attorney-1424461.html">Atlanta tractor-trailer injury lawyer</a>, I was pleased to see the driver of a tractor-trailer charged with two violations for causing a local accident that could have caused serious injuries and deaths.   According to the on line <a href="http://oconee.patch.com/articles/motor-carrier-compliance-officer-charges-driver-of-tractor-trailer-involved-in-441accident">article at OconeePatch.com</a>, the Georgia Department of Public Safety Motor Carrier Compliance Division charge the driver with driving a commercial vehicle without a valid commercial drivers license and violation of DPS transportation rules for having slick tires on his rig.</p>

<p>The tractor-trailer went off one side of the roadway and the driver overcorrected and came back across his own lane and the oncoming lane of traffic and off the roadway and into a tree.  Gratefully, no one was injured except for the driver, who did not appear to be injured seriously. This type of accident, however, where a tractor-trailer travels clear across the roadway into oncoming traffic can cause horrific injuries and deaths. It is a credit to the Motor Carrier Compliance Officer for issuing the citations, even though there were no such injuries or deaths. The citations send a message that violating the traffic laws applicable to tractor-trailers will not be tolerated in this state.</p>]]></description>

            <title>Atlanta Medical Malpractice Lawyer is Keeping an Eye on Proposed Medical Malpractice Legislation</title>
            <description><![CDATA[<p>As a <a href="http://www.victorfaenza.com/lawyer-attorney-1441657.html">medical malpractice lawyer</a> practicing in Atlanta and North Georgia, I try to keep up with the latest proposed legislation both at the state and federal level that would affect Georgia citizens' ability to bring medical malpractice lawsuits. In that regard, I recently came across an article online which discusses proposed legislation in Congress that would severely limit all citizens' ability to bring medical malpractice lawsuits anywhere in the country, including Georgia.</p>

<p>The first thing the new legislation would do is cap non-economic damages at $250,000. This is the same type of cap that the Georgia General Assembly tried to install in its 2005 tort reform legislation, which was found unconstitutional under the Georgia Constitution.  (Please see my <a href="http://www.atlantapersonalinjurylawyersblog.com/2010/03/the-georgia-supreme-court-stri.html">earlier Blog </a>on this issue.)  Because the new caps would become federal law, they can only be determined to be unconstitutional under our federal Constitution.  Accordingly, that Georgia caps where unconstitutional, the federal caps may not be. </p>]]></description>

            <description><![CDATA[<p>As an <a href="http://www.victorfaenza.com/lawyer-attorney-1619309.html">Atlanta dog bite Injury lawyer</a> I was pleased to hear that our General Assembly is moving forward with its efforts to pass a law that would hold owners of dangerous and vicious dogs more responsible for the bad behavior of their pets.  Although I am not certain at this time which exact breeds will be classified as dangerous and vicious (or whether there will be an individual determination for specific dogs), I am sure we can expect Pit Bulls and Rottweilers to be on the top of the list.  As we all know, these breeds, especially Pit Bulls, have been responsible for serious injuries and deaths in Atlanta and north Georgia for many years.</p>

<p>It appears there are a number of things the law will do.  If the law as currently written is passed, it appears Georgia citizens will not be allowed to own a dangerous or vicious dog unless they buy liability insurance providing coverage of at least $50,000.  I think this is a great requirement because in my practice it is not uncommon to have a client who has been seriously injured by a Pit Bull or other vicious dog and the owner has NO insurance.  Often, medical bills alone arising from a serious dog bite can be tens of thousands of dollars.  Additionally, the physical and as importantly, the emotional, pain and suffering, as well as the often disfiguring lifetime scars suffered by dog bite victims allow juries to award significant money damages when a lawsuit is filed.</p>]]></description>

            <title>Atlanta Car Accident Lawyers Can Now Pursue Retailers Who Sell Alcohol to Drunk Drivers Who Hurt or Killed on Georgia Roads</title>
            <description><![CDATA[<p>Because of a recent landmark case, <a href="http://www.victorfaenza.com/lawyer-attorney-1619311.html">Atlanta car accident lawyers</a> can now seek injury and wrongful death damages against retailers who sell closed or packaged alcoholic beverages to drunk drivers who hurt or kill on Georgia roads.  The Georgia Supreme Court held in <u>Flores v. Exprezit! Stores 98 - Gerogia, L.L.C.</u>, No. S10G1652, that the Georgia Dram Shop Act allows those hurt or killed by drunk drivers to recover damages against convenience stores, grocery stores, mom and pop roadside stores, and other retailers who sell alcohol to those noticeably intoxicated who cause accidents.</p>

<p>Before the Supreme Court ruling, the Dram Shop Act, the law that allows claims against those who sell alcoholic beverages to drunk drivers, only applied to restaurants and bars, or others who actually poured alcohol to drunk drivers.  Now Atlanta and Georgia car accident lawyers can pursue retailers, in addition to restaurants and bars, to recover damages for those seriously injured and the families of those killed by drunk drivers.  This is extremely important because DUI drivers often have very little or no insurance to satisfy judgments in favor of the injured or killed.</p>]]></description>
